Gerry Spence says, “We were born to make the winning argument, just as we were born to walk.” In his bestselling book, the preeminent American trial lawyer and grandmaster of argument tells us how.
Gerry Spence has been a trial attorney for more than five decades and proudly represents “the little people.” He has fought and won for the family of Karen Silkwood, defended Randy Weaver at Ruby Ridge, and represented hundreds of others in some of the most notable trials of our time. He is the founder of Trial Lawyer’s College, a nonprofit school where, pro bono, he teaches attorneys for the people how to present their cases and win against powerful corporate and government interests. He is the author of fifteen books, including The New York Times bestseller How to Argue and Win Every Time, From Freedom to Slavery, Give Me Liberty, and The Making of a Country Lawyer, and is a nationally known television commentator on the famous trials of our time. He lives in Jackson Hole, Wyoming.
The Laws of Arguing According to Gerry Spence
1. Everyone is capable of making the winning argument.
2. Winning is getting what we want, which also means helping “others” get what they want.
3. Learn that words are a weapon, and can be used hostilely in combat.
4. Know that there is always a “biological advantage” of delivering the TRUTH.
5. Assault is not argument.
6. Use fear as an ally in public speaking or in argument. Learn to convert its energy.
7. Let emotions show and don’t discourage passion.
8. Don’t be blinded by brilliance.
9. Learn to speak with the body. The body sometimes speaks more powerfully than words.
10. Know that the enemy is not the person with whom we are engaged in a failing argument, but the vision within ourselves.

Well, can’t argue with this! Thanks very much.

Maybe I’ll finally get somewhere with the other half…

Abject capitulation is the way to go, Tiger. Or yet another moral victory.

Surprised he was only divorced once.

So, what happens if I argue with someone else who’s read this book ?

“I know you are but what am I?”

@avatar - Merely hit them with said, physical book, thus giving you a thumping, material advantage.
Wait for them to turn away in disgust before you deploy your secret weapon. May physical force be with you.

God I bet a book like this makes you an insufferable twat.

I don’t see the purpose of a book like this. Winning an argument just for the sake of winning purposely ignores the fundamental reason arguments happen. Arguments are about differences. Abandoning any and all willingness to listen to the other party is why we fight and argue. This book is basically saying, “find one insignificant faulty line in ones argument and make the argument about that”. Shouldn’t we instead be reading books on how to be better listeners and more reasoned in our approaches to discussions? Taking a look at the climate in America as of 2021 I seems this book was written by, and for, screeching protestors whom so desperately clings to “winning” an argument in order to have any self satisfaction because their lives lack meaning.

wheresmycannon, I think you won the argument. ;)

So, if 2 people read this book and decide to argue…who wins?

I read this book in paper and still own it. The point is to win by making sure that everyone gets what they want. Not win against, but win with the other side. Excellent book, thank you for sharing it

My assessment above is wrong. I conflated this book with another one I read. Spence is pompous, self absorbed, insufferable twat and this book is his confession of that. My bad.
